Terms and Conditions

1. Agreement

These Terms and Conditions ("Terms") govern your access to and use of the POE Hideout Art Tool website, accounts, free previews, subscriptions, credit packs, public gallery and all related features (together, the "Service"). "We", "us" and "our" refer to POE Hideout Art Tool. "You" means the person using the Service.

By creating an account, generating a preview, purchasing a subscription or credit pack, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

2. The service

The Service is an online tool for players of the video game Path of Exile and Path of Exile 2. It converts an image you provide into a layout of in-game hideout decorations, shows a preview, and produces a .hideout file that you can import into the game yourself.

Previews are free and limited to a number per day that we set and may change. Free previews do not include the .hideout file. Unlocking an artwork gives you its .hideout file and uses one download: either one conversion from a subscription plan or one credit from a credit pack.

The Service is a digital tool provided for personal entertainment. It does not modify the game, interact with the game client, or access your game account.

3. Eligibility and accounts

• You must be at least 13 years old (or the minimum age required in your country to consent to online services) to use the Service. If you are under the age of majority where you live, you may only purchase a subscription with the permission of a parent or guardian.
• You must provide accurate information when you register and keep your email address up to date.
• You are responsible for keeping your password confidential and for all activity under your account. Tell us promptly through our Contact page if you believe your account has been compromised.
• Accounts are personal. You may not sell, share, transfer or rent your account, its conversions or its credits.

4. Previews, downloads, plans and credit packs

You can pay for downloads in two ways: a recurring subscription, billed monthly or yearly, or a one-time credit pack. Yearly billing costs 20% less than twelve monthly payments.

• Prices are listed on our Plans page in US dollars. Your local currency, the final price and any applicable taxes are shown at checkout before you pay.
• A subscription's conversions are added at the start of each month of your subscription. This applies to yearly plans too: a yearly plan is paid once a year and its conversions are credited month by month. Unused conversions do not roll over to the next month and have no cash value.
• Credit pack credits do not expire while your account exists. They have no cash value and cannot be transferred or exchanged.
• A download is used when you unlock an artwork. If you have both, your monthly conversions are used first (because they expire), then your pack credits. Generating previews never uses a download.
• An unlocked artwork can be downloaded again at no cost for as long as we keep the result, currently 7 days. Please keep your own copy of the .hideout file.
• You can change plans at any time from the Plans page. Upgrades (a higher plan on the same billing period, or monthly to yearly on the same or a higher plan) take effect immediately: you are charged the prorated difference and extra conversions are added right away. Downgrades and yearly to monthly switches are scheduled for your next renewal: you keep your current plan until then. You can cancel a scheduled switch before it takes effect at no charge.
• We may, at our discretion, change the number of free previews, or offer free conversions, credits, trials or promotions. These may be changed or withdrawn at any time and are subject to these Terms.

5. Billing and renewal

• Credit packs are one-time purchases and never renew or charge you again.
• Subscriptions renew automatically at the end of each billing period (every month for monthly plans, every year for yearly plans), and your payment method is charged at the then-current price until you cancel.
• If you need help with billing that is not covered on the Plans page, contact us through the Contact page.
• Payments are processed by our third-party payment provider. Your payment details are handled by that provider and are not stored on our servers. The provider's own terms and privacy policy also apply to your payment.
• If a payment fails, we or our payment provider may retry the charge. If payment cannot be collected, your subscription may be paused or cancelled and no new conversions will be added.
• We may change subscription prices. Any price change will be communicated in advance and will apply from your next billing month after the notice. If you do not agree to a new price, you may cancel before it takes effect.

6. Cancellation

You can cancel your subscription at any time. Cancellation stops future renewals. Your subscription stays active until the end of the billing period you have already paid for (the current month for monthly plans, the current year for yearly plans), and you continue to receive and use your monthly conversions until then. No further charges are made after that.

7. No refunds

All payments are final and non-refundable. The Service is a digital product that is made available to you immediately after payment. Conversions are credited to your account as soon as your subscription starts or renews, and pack credits as soon as your pack purchase completes.

By purchasing a subscription or credit pack, you request immediate access to the Service and expressly agree that the supply of digital content begins immediately. You acknowledge that, to the extent permitted by law, you therefore lose any statutory right of withdrawal or cancellation that would otherwise apply to the purchase.

We do not provide refunds for partially used billing months, unused conversions or credits, downgrades, or for results in the game that differ from your expectations. Nothing in this section limits any rights you may have that cannot be excluded under the consumer protection law that applies to you.

8. Support and issue resolution

If you experience a problem with the Service, such as a failed generation, a file that does not import, or a billing question, please contact us through our Contact page and choose Report a bug. Include as much detail as you can, and screenshots where helpful. We will review your message and reply by email, and we will make reasonable efforts to resolve the issue, which may include fixing the problem or, at our sole discretion, restoring conversions or credits affected by an error on our side.

9. Acceptable use

You agree not to:

• use the Service for any unlawful purpose or in breach of these Terms;
• upload images that you do not have the right to use, or content that is illegal, sexually explicit involving minors, hateful, harassing, or that infringes anyone's rights;
• attempt to bypass usage limits, rate limits, payment or account restrictions, including by creating multiple accounts or using other means to obtain extra free previews, conversions or credits;
• scrape, crawl, copy or resell the Service, its data or its catalogue of decorations and renders, or build a competing service from them;
• reverse engineer, probe, attack, overload or interfere with the Service or its security, or use automated tools to access it;
• send spam, abusive or misleading messages through the Contact page;
• impersonate any person or misrepresent your affiliation with anyone.

10. Your content

You keep ownership of the images you upload. You confirm that you own them or have permission to use them. You grant us a limited, worldwide, non-exclusive licence to store and process your images solely to provide the Service to you (for example, to generate your art, previews and files). We do not use your images for any other purpose and do not sell them.

You are responsible for the content you upload. We may remove content, or refuse to process it, if we reasonably believe it breaches these Terms or the law.

Sharing. If you use the Share button, your original image and its preview are published on a public page that anyone with the link can open. By sharing, you confirm you have the right to publish that image, and you grant us a worldwide, non-exclusive, royalty-free licence to display it on the Service, including in our public gallery and in promotion of the Service. Shared pages are not listed in search engines unless we feature them. You can ask us to remove a shared page at any time through our Contact page.

11. Generated output and game results

You may use the previews and .hideout files generated for you for your own personal, non-commercial use in the game and to share your hideout with others.

Please note:

• The preview is a computer rendering. The appearance in the game can differ because of in-game lighting, graphics settings, camera angle, game updates and other factors.
• The game only places decorations that you have unlocked in your account, and only imports a file into the matching hideout type. We cannot unlock decorations for you.
• Game updates by the game's developer may change decorations, hideouts or the import feature at any time, which may affect files generated before or after such changes.
• Importing a hideout file may replace your current hideout layout. Export or back up your hideout in the game before importing.

12. Intellectual property and Path of Exile

The Service, including its software, design, text and branding, is owned by POE Hideout Art Tool and protected by intellectual property laws. Subject to these Terms and your active subscription where required, we grant you a limited, personal, non-transferable, revocable licence to use the Service.

POE Hideout Art Tool is an independent fan-made tool. It is not affiliated with, endorsed by, or sponsored by Grinding Gear Games. Path of Exile, Path of Exile 2 and related names, images and game assets are trademarks or property of Grinding Gear Games and are used here only to identify the game and its content.

13. Disclaimer of warranties

To the fullest extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express, implied or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, or that the Service will be uninterrupted, error-free, secure, or compatible with any version of the game.

We do not guarantee any particular artistic result, that generated art will look identical in the game, or that the game will accept any file.

14. Limitation of liability

To the fullest extent permitted by law, POE Hideout Art Tool will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data, goodwill, in-game items, in-game progress, hideout layouts or game account access, arising out of or related to your use of, or inability to use, the Service, even if we have been advised of the possibility of such damages.

To the fullest extent permitted by law, our total liability for all claims relating to the Service is limited to the amount you paid us for the Service in the one (1) month before the event giving rise to the claim.

Some jurisdictions do not allow certain exclusions or limitations of liability, so some of the above may not apply to you. Nothing in these Terms excludes liability that cannot be excluded by law.

15. Indemnity

You agree to indemnify and hold harmless POE Hideout Art Tool from any claims, losses, liabilities and expenses (including reasonable legal fees) arising from your content, your use of the Service, or your breach of these Terms or of any law or third-party right.

16. Suspension and termination

We may suspend or terminate your access to the Service, with or without notice, if you breach these Terms, if we are required to by law, if your payment fails, or to protect the Service or other users. If your account is terminated for a breach of these Terms, you are not entitled to a refund of any fees or to any remaining conversions.

You may stop using the Service and request deletion of your account at any time through our Contact page. Sections that by their nature should survive termination (including 7, 10 to 15 and 18) will survive.

17. Changes to the service and these terms

We are continually improving the Service and may add, change or remove features, decorations, hideouts or plans at any time. We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date above and, where appropriate, notify you by email or on the website. Continued use of the Service after changes take effect means you accept the updated Terms.

18. General

• Force majeure. We are not responsible for any delay or failure caused by events beyond our reasonable control, including outages of hosting, internet or payment providers, or changes to the game.
• Applicable law. These Terms are governed by the laws that apply to the operator of the Service, without regard to conflict-of-law rules. This does not deprive you of the protection of mandatory consumer laws of the country where you live.
• Disputes. Before starting any formal dispute, you agree to contact us first so that we can try to resolve the matter informally.
• Severability. If any provision is found unenforceable, the rest of these Terms remain in effect.
• No waiver. Our failure to enforce any provision is not a waiver of our right to do so later.
• Assignment. You may not transfer your rights under these Terms. We may transfer ours as part of a reorganisation, sale or transfer of the Service.
• Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and us regarding the Service.
